All orders for goods accepted by Chatwins Bakery ("Chatwins Bakery") are accepted subject to the following conditions that shall form part of and govern the contract of sale.

Acceptance of goods shall be deemed to be acceptance of these conditions of sale. No agent or representative of Chatwins Bakery has the authority to vary these conditions unless endorsed in writing by a Director of the company.

Please note: All orders for products or services will be acknowledged but confirmation of the price shall at all times be when the order is accepted by Chatwins Bakery and such orders shall be shipped at the prices shown on the order acceptance which shall normally be the price or cost as shown on our Web Site on the date of the order. Up to date prices can be found on our Web Site which is continuously updated.

Terms: Orders are shipped with any delivery costs shown where appropriate.

Payment, Delivery and Price

A) Payment is to be made via credit or debit card or other method shown as acceptable on this Web Site and no other methods of payment are acceptable unless otherwise agreed in writing by Chatwins Bakery and no goods shall be dispatched until payment has been made to and accepted by Chatwins Bakery. Credit card companies may require address verification (your credit card billing address) or other security information on web site transactions. Any incorrect information given may result in a delayed or cancelled order for which Chatwins Bakery accepts no responsibility.

B) Chatwins Bakery shall dispatch goods to the purchaser on the chosen date for delivery provided that all monies due have been received or shall notify the purchaser if goods are unavailable or if there is any delay which may result in goods being delivered outside this period. In the event of a delay being more than 28 days Chatwins Bakery shall offer the purchaser the right to cancel the order and shall make immediate refund to the purchaser of monies paid if the order is cancelled by the purchaser resulting from the delay.

C)In the event that any goods are unavailable, Chatwins Bakery shall make a refund to the purchaser of monies paid or notify the purchaser if only part of an order can be fulfilled and offer the purchaser the opportunity to accept part of the order. If the purchaser accepts part of the order Chatwins Bakery shall make refund to the purchaser of monies paid relating to the unavailable goods only. If the purchaser declines to accept part of the order a full refund of monies paid shall be made by Chatwins Bakery.

D)Our policy requires 100% prepayment in advance for any orders made from this web site. Such payments are not refundable once the merchandise is ordered except as shown in these terms.

2. Liability
A) Liability for any claim for damage by the purchaser shall diminish with delay in notification to Chatwins Bakery and the purchaser should notify Chatwins Bakery of any damage to goods within one day of delivery. This period may be extended at the sole discretion of Chatwins Bakery.

B) In the event that goods differ in quantity or description from those ordered the purchaser shall notify Chatwins Bakery in writing immediately and failure to do so could diminish the liability of Chatwins Bakery.

3. Returned Goods
A) The purchaser shall unless otherwise stated be responsible for the cost of return of all goods to Chatwins Bakery and the returned goods shall be at the risk of the purchaser until actual receipt of the goods by Chatwins Bakery. The onus of proof of safe delivery shall rest with the purchaser.

B) No credit shall be allowed for goods until they have been received complete.

C) A full credit including carriage costs shall be given by Chatwins Bakery to the purchaser in the event that goods are faulty or damaged at the time of delivery and notice of fault or damage is given by the purchaser to Chatwins Bakery immediately upon receipt.

D) Refused Shipments: Shipments returned marked refused will not result in refund and refusal of a shipment does not relieve the purchaser’s liability for paying any carriage charges incurred in the return of the goods to Chatwins Bakery.

4. Consequential Loss
The extent of Chatwins Bakery liability to the purchaser for any default or breach whatsoever and howsoever arising shall in no case exceed the invoice value of the goods and Chatwins Bakery shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or by any customer of the purchaser and whether direct or indirect consequential or howsoever arising except where the parties to the transaction could have contemplated such a loss at the time of the contract.

5. Law
A) If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions provided the contract is capable of continuing without such terms and conditions.

B) These terms shall be deemed to have been made in England and shall in all respects be governed by English Law except where the statutory rights of consumers within the European Union are otherwise protected within the law of the state or country of delivery.

C) In respect of consumer statutory rights within the European Union these are unaffected by these terms and conditions.

7. Consumer Rights 

The terms and conditions listed for citizens of the European Union are determined by specific consumer legislation and the rights of the purchaser are governed by such consumer legislation. If there is any conflict between the Terms and Conditions of this Web Site and consumer legislation the rights of the consumer under the legislation will not be affected.

8. Methods of Payment 

EU residents pay the VAT inclusive price (VAT at appropriate rate, currently 20%). Non-EU/exempt pays the VAT exclusive price.

Payment is only accepted by credit/debit card unless otherwise agreed with Chatwins Bakery. Visa, Mastercard, American Express, Switch and Delta cards are acceptable subject to individual credit/debit limits and the authorisation policy ofthe card issuing organisations We cannot accept any responsibility or liability in the event that a card payment fails or is refused.

9. Suitability of Goods or Services

We do not warrant the suitability of goods or services for a particular purpose other than that illustrated within product/service instructions specifications or guides and purchasers should check specifications size and suitability before ordering.

Security on the transaction is protected by secure server process via Stripe. Specific security information may be obtained by viewing their website at www.stripe.com

The cost of any telephone calls shall be at the applicable rate of the Country of origin. No premium rate telephone charges are levied by this organisation nor do we receive any share of any telephone call charges. Competition Terms and Conditions

Competition rules shall be binding on you when entering any competition(s) operated by us.In addition to these general competition rules, other specific terms and conditions may also apply to a particular competition. We will post any such specific competition rules on our website.

Competitions are open to all UK residents aged 18 or over, except for employees of Chatwins Bakery and any company associated to the specific competition, their families, or anyone else who is professionally associated with the competition.

Only one entry per person is permitted, unless otherwise stated. Automated entries will be invalidated, including multiple entries from the same IP Address.

The closing date is as specified in the relevant competition. This will always be a time and date in the UK. Where a time is not given, the closing time will be 11.59pm (UK time) on the stated day.

Proof of sending post/e-mail/SMS, making a phone call or completing an online entry, is not proof of our receipt of your entry. No responsibility can be accepted for entries that are lost, delayed or damaged.

All entries must be received by the closing date specified in the individual promotion/competition rules. All eligible entries received by the closing date have an equal chance of winning. Entries not submitted in accordance with the rules or incomplete or illegible entries will be disqualified.

Competitions are open to customers and non-customers. No purchase is necessary.

The draw will take place on the date stated in the individual competition rules and winners will be formally notified (by email, post or phone) within 21 days of the closing date. Prizes must be claimed within 5 days of notification.

Any prize will be awarded to the first valid entry drawn at random by an independent, supervised individual. The decision is final and no correspondence will be entered into by Chatwin Bakery in relation to that decision.

Any prize is as specified in the individual competition rules. No alternative prizes may be requested although Chatwins Bakery reserves the right to alter arrangements or prizes should this be unavoidable. There is no cash alternative and prizes cannot be transferred to any other person.

Chatwins Bakery will not be liable for any damage, loss or disappointment suffered by any person taking part or not being able to take part in a competition.

It is a condition of entry that any winner consents to their name and country of residence to be published on the website for a minimum of 14 days after the closing date. Competition winners may be required to take part in or co-operate with post-event publicity.

Competition winners agree to keep confidential any knowledge about Chatwins Bakery and its business and personnel received by them as a result of the competition.

No responsibility is accepted for inaccurate prize details supplied by sponsors.

In the event of unforeseen circumstances, Chatwins Bakery reserves the right to alter, amend or foreclose the competition without prior notice.

Use of false name or address, e.g. name by which the entrant is not usually known, will disqualify them from receiving any prize. Chatwins Bakery reserves the right to oblige any potential winner to provide documentary proof of their identity and address as directed by Chatwins Bakery before such person may claim their prize.

We will keep your personal details for a reasonable time so that we can send you any prize that you have won, to verify that these rules have been complied with, and for accounting purposes. We may pass your details on to our service providers and agents for the purposes of sending you the prize on our behalf.

These rules are governed by English law.

To be entered into a Chatwin’s Craft Bakery competition, entrants must complete their details in the manner specified for each competition.

We reserve the right to amend these rules at any time. By entering any competition all participants will be deemed to have accepted and be bound by the rules and by any other requirements set out in the competition material.

Enquiries relating to the competition (including enquiries about the name of the eventual winner or the personal data collected about you as a result of your entry) should be addressed to "Competitions & Terms" and sent to Chatwins Bakery at the above address. The competition is run via the Chatwins Bakery website www.chatwins.co.uk. Entrant details provided will be used only for informing winners of results and will thereafter be destroyed, unless wider use has been permitted by the entrant. Chatwins Bakery reserves the right to disclose the name of the winner on request from a third party.
